En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo (...) acápite, mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. Los objetivos específicos son los siguientes: (i) reconstruir en forma sistemática la relación entre λόγος y ἔθος/ἄσκησις desarrollada por Musonio Rufo en las Disertaciones 5 y 6; (ii) postular las reflexiones de Aristóteles sobre el problema de la habituación como un marco conceptual relevante para encuadrar el análisis de ambas disertaciones; (iii) analizar las posibles tensiones lógicas entre la concepción de Musonio de ἔθος/ἄσκησις y la concepción intelectualista de la acción humana defendida por la ortodoxia estoica. Sugeriré asimismo que (...) el recurso a las Dissertationes de Epicteto puede ofrecer una respuesta tentativa a interrogantes no resueltos en las Disertaciones 5 y 6. -/- The specific goals are the following: (i) to put together in a systematic manner the relationship between λόγος and ἔθος/ἄσκησις presented by Musonius Rufus in Lectures 5 and 6; (ii) to propose Aristotle’s reflections on the problem of habituation as a relevant framework to make sense of both lectures; (iii) to analyze the possible logical conflicts between Musonius’ conception of ἔθος/ἄσκησις and the intellectualist conception of human agency defended by Stoic orthodoxy. La epistemología bayesiana tiene como concepto capital la condicionalización simple. Para comprender de buena forma cómo opera esta regla, se debe dar cuenta de la concepción subjetiva de la probabilidad. Sobre la base de lo anterior es posible esclarecer alcances y límites de la condicionalización simple. En general, cuando esta regla enfrenta una dificultad se hacen esfuerzos por resolver dicha particular cuestión, pero no es usual encontrar propuestas unificadas con la intención de resolver varias de las complicaciones subyacentes al bayesianismo (...) ortodoxo. Por lo mismo, el propósito de esta investigación es justamente proponer aquello: un marco bayesiano ampliado que tendrá por objeto solucionar más de una cuestión particular. Más específicamente, el problema de la incorregibilidad, el problema del surgimiento del cero, el problema de la evidencia antigua y el problema de las teorías nuevas. Lo anterior se logrará adicionando al bayesianismo ortodoxo dos cuestiones, a saber, la condicionalización épsilon y una reconstrucción racional. En el marco de los estándares profesionalizantes de la academia, con sus “rankings” y productividad científica, las humanidades subsisten. Una explicación de este fenómeno es que, según la ontología social, las razones para la acción independiente de deseos son piezas clave en la educación. Por ello, dichas razones, que constituyen obligaciones, también serían claves para el desarrollo de las humanidades. Aquí examino de qué forma el individualismo y la competencia tensionan la dinámica entre deseos y obligaciones. As neuroscience progresses, we will not only gain a better understanding of how our brains work, but also a better understanding of how to modify them, and as a result, our mental states. An important question we are faced with is whether the state could be justified in implementing such methods on criminal offenders, without their consent, for the purposes of rehabilitation and reduction of recidivism; a practice that is already legal in some jurisdictions. By focusing on a prominent type (...) of view of free action, which I call bypassing views, this paper evaluates how such interventions may negatively impact the freedom of their subjects. The paper concludes that there will be a tension between the goals of rehabilitation and reduction of recidivism, on the one hand, and the negative impact such interventions may have on free action, on the other. Other things equal, the better that a particular intervention is at achieving the former, the more likely it is to result in the latter. (shrink)

A common style of argument in the literature on free will and moral responsibility is the Manipulation Argument. These tend to begin with a case of an agent in a deterministic universe who is manipulated, say, via brain surgery, into performing some action. Intuitively, this agent is not responsible for that action. Yet, since there is no relevant difference, with respect to whether an agent is responsible, between the manipulated agent and a typical agent in a deterministic universe, responsibility is (...) not compatible with the truth of determinism. In response, some theorists have argued that there is a relevant difference, and have developed two sorts of accounts of that difference: bypassing views, and manipulator-focused views. Manipulator-focused views suggest that the difference concerns the presence of a manipulator, whereas bypassing views suggest that the relevant difference concerns the fact that the action issues from attitudes that the manipulated agent acquired in a way that bypassed her capacities for control over her mental life. One sort of case used to decide between these sorts of accounts is a case of machine induction, which is just like a manipulation case, yet the change in the agent is the result of some natural force. Against the received view, Xiaofei Liu argues that such cases pose problems for bypassing views, and favor manipulator-focused views instead. This paper addresses Liu’s arguments, as well as a variety of cases, concluding that cases of machine induction do not provide motivation for a bypassing theorist to adopt a manipulator-focused view. As it is known, there is no rule satisfying Additivity in the complete domain of bankruptcy problems. This paper proposes a notion of partial Additivity in this context, to be called µ-additivity. We find that µ-additivity, together with two quite compelling axioms, anonymity and continuity, identify the Minimal Overlap rule, introduced by Neill (1982).

The Case of Jim: Jim was arrested arriving at the house of an unattended minor, having brought with him some alcoholic drinks, condoms, and an overnight bag. Records of online conversations Jim was having with the minor give the court strong evidence that the purpose of this meet-up was to engage in sexual relations with the minor. In the course of searching his home computer, investigators also found child pornography. Jim was charged with intent to sexually abuse a child and (...) possession of child pornography. He was given due process, and convicted, by a jury of his peers, on both counts. This is not the first time that Jim has been convicted of a sexual offence. This book is the result of a collective research effort performed during many years in both Sweden and Spain. It is the result of attempting to develop a new field of research that could we denominate «human act informatics.» The goal has been to use the technologies of information to the study of the human act in general, including embodied acts and disembodied acts. The book presents a theory of the quantification of the informational value of human acts as order, (...) opposing the living order against entropy. We present acting as a set of decisions and choices aimed to create order and to impose Modernity. Karl Popper’s frequency theory of probability is applied to characterize human acts regarding their degree of freedom and to set up a scale of order in human decisions. The traditional theory of economics and social science characterize the human act as rational, utilitarian and ethical. Our results emphasize that the unique significance of an act lies in its capacity to generate order. An adequate methodology is then presented to defend such hypothesis according to which, the rationality respective irrationality of acting, is in fact only a function of the act’s organizational capacity. From this perspective, it has been necessary to define «order» respective «disorder» as operative concepts that allowed the comparison of the organizational differences generated by each kind of act. According to the presented conclusions, the spontaneity of living, as unconscious thinking, dreaming, loving, etc. and the mainstream of the human acts, are utilitarian, but in an irrational way; they are rooted in unconscious drifts and therefore must be considered irrational-utility acts. The 20th Century is the starting point for the most ambitious attempts to extrapolate human life into artificial systems. Norbert Wiener’s Cybernetics, Claude Shannon’s Information Theory, John von Neumann’s Cellular Automata, Universal Constructor to the Turing Test, Artificial Intelligence to Maturana and Varela’s Autopoietic Organization, all shared the goal of understanding in what sense humans resemble a machine. This scientific and technological movement has embraced all disciplines without exceptions, not only mathematics and physics but also biology, sociology, psychology, economics etc. (...) New terms were developed, such as “information”, “organization”, “entropy”, “communication”, “encryption”, “computation” and “algorithmics” to mention a few, all which had an enormous impact on artificial systems. Our work follows this historical track but with a reversed order of priorities. Instead of deducing a reduced group of human acts into an artificial environment, we deduce the human aspects of machines by extrapolating algorithmic methodologies into everyday life acts. The present informational theories were insufficiently powered to achieve this objective without developing a new theoretical approach. Hence, our research is directed towards an expansion of the current informational theories. (shrink)

Resumo Neste artigo, procura-se analisar os fatores envolvidos na determinação da natureza substancial do organismo vivo, em Aristóteles. Tais fatores seriam, por um lado, a forte unidade e coesão interna composicional e, por outro, o elevado caráter de independência quanto às propriedades essenciais ou formais, relativamente às propriedades dos componentes materiais, por meio dos quais o organismo vivo vem a ser formado, ou com referência aos outros tipos de particularidades de seres. Com esta análise, pretende-se mostrar, ao mesmo tempo, que (...) a unidade do composto orgânico-animado, de um modo geral, é constituída por um complexo arranjo de camadas estratificadas, no qual as camadas ou os tipos de composições materiais apresentam, entre si, um forte grau de interdependência. Tal interdependência entre as partes materiais, que formam uma rede composicional complexa e bem-articulada, faz com que as propriedades essenciais ou formais do todo orgânico se diferenciem sobremaneira das propriedades essenciais dos tipos de componentes que integram esse todo, caracterizando, assim, o caráter substancial da composição orgânica.In this paper, I will try to analyze the factors involved in determining the substantial nature of the living organism in Aristotle. Such factors would be, on the one hand, the strong unity and compositional internal cohesion and, on the other hand, the high character of independence as regards the essential or formal properties, relative to the proper properties of the material components through which the living organism comes to be formed, or relative to other types of particularities of beings. With this analysis, it is intended at the same time to show that, in a general way, the unity of the organic-animate compound is constituted by a complex arrangement of stratified layers, in which the layers or types of material compositions have a strong degree of interdependence among themselves. Such interdependence between the material parts, which form a complex and well-articulated compositional network, makes the essential or formal properties of the organic whole very different from the essential properties of the types of components that make up the whole, thus characterizing the substantial character of organic composition. Recent advancements in the brain sciences have enabled researchers to determine, with increasing accuracy, patterns and locations of neural activation associated with various psychological functions. These techniques have revived a longstanding debate regarding the relation between the mind and the brain: while many authors claim that neuroscientific data can be employed to advance theories of higher cognition, others defend the so-called ‘autonomy’ of psychology. Settling this significant issue requires understanding the nature of the bridge laws used at the psycho-neural interface. (...) While these laws have been the topic of extensive discussion, such debates have mostly focused on a particular type of link: reductive laws. Reductive laws are problematic: they face notorious philosophical objections and they are too scarce to substantiate current research at the intersection of psychology and neuroscience. The aim of this article is to provide a systematic analysis of a different kind of bridge laws—associative laws—which play a central, albeit overlooked role in scientific practice. (shrink)

Why are mistaken beliefs about Covid-19 so prevalent? Political identity, education and other demographic variables explain only a part of individual differences in the susceptibility to Covid-19 misinformation. This paper focuses on another explanation: epistemic vice. Epistemic vices are character traits that interfere with acquiring, maintaining, and transmitting knowledge. If the basic assumption of vice epistemology is right, then people with epistemic vices such as indifference to the truth or rigidity in their belief structures will tend to be more susceptible (...) to believing Covid-19 misinformation. We carried out an observational study (US sample, n = 998) in which we measured the level of epistemic vice of participants using a novel Epistemic Vice Scale. We also asked participants questions eliciting the extent to which they subscribe to myths and misinformation about Covid-19. We find overwhelming evidence to the effect that epistemic vice is associated with susceptibility to Covid-19 misinformation. In fact, the association turns out to be stronger than with political identity, educational attainment, scores on the Cognitive Reflection Test, personality, dogmatism, and need for closure. We conclude that this offers evidence in favor of the empirical presuppositions of vice epistemology. (shrink)

To improve oneself and grow professionally, career development has been found to be crucial, as it serves as a roadmap for the professional growth of employees. However, a barrier, known as the glass ceiling, hinders the progress of employees, especially those in the LGBTQIA+ community. This study explores the impact of the glass ceiling on the career development of selected LGBTQIA+ individuals, shedding light on the barriers faced by this community in the workplace. The researchers used a qualitative multiple-case study (...) and selected ten (10) LGBTQIA+ participants from large enterprises via the judgmental sampling technique. Through thematic analysis, psychological impact, workplace discomfort, lack of recognition, and career progress challenges emerged as the impacts of the glass ceiling on the participants. Strategies for overcoming glass ceiling barriers, such as resilience, self-reflection, and community support, are identified. Thus, the study found that glass ceilings are really evident in the context of businesses. With this, the proposed advocacy plan in the study suggests interventions like workplace inclusion training, mentorship networks, and seminars on employee rights. Furthermore, it emphasizes the call for ongoing research and advocacy efforts to dismantle barriers and cultivate workplaces that not only embrace diversity but also provide equitable opportunities for career growth. In this paper, we explore the conceptual problems arising when using network analysis in person- centered care (PCC) in psychiatry. Personalized network models are potentially helpful tools for PCC, but we argue that using them in psychiatric practice raises boundary problems, i.e., problems in demarcating what should and should not be included in the model, which may limit their ability to provide clinically-relevant knowledge. Models can have explanatory and representational boundaries, among others. We argue that we can make more explicit (...) what kind of questions personalized network models can address in PCC, given their representational and explanatory boundaries, using perspectival reasoning. Com este artigo, pretendo examinar a maneira pela qual ocorreria a necessidade natural, em seus diversos aspectos, nos distintos processos gerativos composicionais em Aristóteles. Em um caso, a necessidade natural se daria de um modo "sem mais", ou de um modo absoluto, por meio da qual se geram os agregados. Em outro, a necessidade natural se realizaria a partir de um princípio anterior regulativo ou determinante, que Aristóteles denomina de necessidade ex hupoteseos, com relação aos processos envolvidos na constituição dos (...) corpos homogêneos inanimados e, dos organismos vivos. No entanto, haveria uma diferença essencial relativamente ao acabamento composicional associado, por um lado, aos corpos homogêneos inanimados e, por outro, aos organismos vivos. Enquanto que o acabamento constituinte das composições homogêneas inanimadas se restringiria apenas ao todo composicional e suas propriedades características, o acabamento dos organismos vivos corresponderia ao todo composicional e as suas propriedades características, bem como este acabamento em vista da realização das atividades orgânico-funcionais, ou vitais. in this article, we experience the exercise of a screen ethnocartography in agency with the film Beasts of the southern wild by the director Benh Zeitlin. We tested a film experimentation that led to a renewed writing ways of life. We bet on cinema and childhood as possibilities for creating cracks and a stutter of language for the creation of new worlds and ways of living. In cinema images less as a representation, and more as art that proposes incompleteness, fissure, (...) a hole in appearances. In childhood as an exercise of differentiation and resistance to dominant narratives in a given context. In childhood as a limiting experience of/in language, tirelessly exposing the human condition in front of the world. Thus, accompanying the main character of the plot, little Hushpuppy — a six-year-old resident of the “Charles Doucet Island”, experienced as “the Bathtub” —, we are shaken by the forms of life there, considered bestial and not recognized by city humans. Hushpuppy, his father and friends resist attempts to destroy their existence by the forms of the state that try to domesticate them, imbued with the logic that primitives must come to civilization, just as children must become adults. The results are interpreted in terms of a deficit in initial rule learning and subsequent generalization of these rules to new stimuli. Negative feedback is adequately processed at a neural level but this information is not used to improve behaviour on subsequent trials. As learning is degraded, the process of error detection at the moment of the actual response is diminished. This paper introduces new logical systems which axiomatize a formal representation of inconsistency (here taken to be equivalent to contradictoriness) in classical logic. We start from an intuitive semantical account of inconsistent data, fixing some basic requirements, and provide two distinct sound and complete axiomatics for such semantics, LFI1 and LFI2, as well as their first-order extensions, LFI1* and LFI2*, depending on which additional requirements are considered. These formal systems are examples of what we dub Logics of Formal Inconsistency (LFI) (...) and form part of a much larger family of similar logics. We also show that there are translations from classical and paraconsistent first-order logics into LFI1* and LFI2*, and back. Hence, despite their status as subsystems of classical logic, LFI1* and LFI2* can codify any classical or paraconsistent reasoning. (shrink)

Nosso ponto de partida são os paradoxos de Zenão. Sabemos que Aristóteles debate diretamente com Zenão no livro IV da Física, enquanto Hume, no Tratado da Natureza Humana discute com a posição de Zenão acerca do espaço renovada por Bayle. Tendo isto em vista, o principal objetivo (...) deste trabalho é o de expor como Aristóteles enfrenta o paradoxo proposto por Zenão acerca do lugar, e como Hume enfrentou o paradoxo proposto por Bayle sobre a constituição do espaço, através de uma apropriação do método de Zenão. The aim of this article is to discuss the conditions under which functional neuroimaging can contribute to the study of higher cognition. We begin by presenting two case studies—on moral and economic decision making—which will help us identify and examine one of the main ways in which neuroimaging can help advance the study of higher cognition. We agree with critics that functional magnetic resonance imaging (fMRI) studies seldom “refine” or “confirm” particular psychological hypotheses, or even provide details of the neural (...) implementation of cognitive functions. However, we suggest that neuroimaging can support psychology in a different way—namely, by selecting among competing hypotheses of the cognitive mechanisms underlying some mental function. One of the main ways in which neuroimaging can be used for hypothesis selection is via reverse inferences, which we here examine in detail. Despite frequent claims to the contrary, we argue that successful reverse inferences do not assume any strong or objectionable form of reductionism or functional locationism. Moreover, our discussion illustrates that reverse inferences can be successful at early stages of psychological theorizing, when models of the cognitive mechanisms are only partially developed. This paper employs structural topic modeling (STM), a text-mining technique, to describe the academic philosophy landscape in Brazil. Based on a public national database, a corpus consisting of 12,515 abstracts of monographs (theses and dissertations) defended in Philosophy Graduate Programs between 1991 and 2021 was compiled. The final STM model identified 74 meaningful research topics, clustered into 7 thematic categories. This study discusses the prevalence of the most significant topics and categories, their trends across three decades and their (positive or (...) negative) association with the supervisor’s gender. Results show the first empirical evidence that Brazilian philosophical research exhibits a greater focus on philosophers and their works, rather than on specific themes or problems, aligning with common sociological perceptions within the academic community. Moreover, by visualizing the variations in topic prevalence over time, it was possible to track the rise or decline of the major interest categories and topics. Finally, results also show how topics related to male philosophers garner greater attention throughout the corpus and which topics are more or less influenced by gender. (shrink)

We thus consider the standard techniques of reducing one system to the other. Novak proved that from a model of ZF we can build a model of NBG (and vice versa), while Shoenfield have shown that from a proof in NBG of a set-sentence we can generate a proof in ZF of (...) the same formula. We argue that the first makes use of a too strong metatheory. Although meaningful, this symmetrical reduction does not equate the ontological content of the theories. The strong metatheory levels the two theories. Moreover, we will modernize Shoenfields proof, emphasizing its relation to Herbrands theorem and that it can only be seen as a partial type of reduction. In contrast with symmetrical reductions, we believe that asymmetrical relations are powerful tools for comparing ontological content. In virtue of this, we prove that there is no interpretation of NBG in ZF, while NBG trivially interprets ZF. This challenges the standard view that the two systems have the same ontological content. Ambas o acompanharam desde a infância e a adolescência, tendo atravessado o seu caminho personagens emblemáticos, que o ajudaram a demarcar o traçado peculiar do seu destino. Formado na Sorbonne, numa época em que ela reunia, com seu corpo docente, um dos mais significativos e completos departamentos de filosofia do ocidente, Fausto Castilho trouxe consigo diversos métodos rigorosos (...) de trabalhar um texto filosófico, sem jamais deixar de ter um pensamento e uma posição refletida sobre os temas aos quais se dedicou. Essa mesma postura sempre marcou sua profunda reflexão sobre o Brasil, que sempre coadunou assuntos estratégicos, vocação tecnológica e formação política, ocupando-se não tanto com a identidade do país – tema que marcou sua geração –, mas muito mais com o seu desenvolvimento e sua inserção cosmopolita. The literature provides different methodologies for sampling social wasps, including, flight intercept trap type Malaise and Attractive trap, however, there is no consensus on its use. In this respect, the aim of this study was to evaluate the best use of Malaise traps and Attractive trap in biodiversity work of social wasps, and generate a collection protocol for the use of these traps. The study was conducted in the Parque Estadual do Rio Doce, located in the east of the state (...) of Minas Gerais, in the years 2000, 2001, 2002 and 2004 and in the Botanical Garden of the Federal University of Juiz de Fora, located in the southeastern state of Minas Gerais, in years 2011, 2012 and 2013. 15 species were collected using Malaise traps, and, 26 species of social wasps were collected using Attractive traps. Although the negative aspects of both traps, complementary methodologies surveys varying social wasps are useful and it is recommended to choose for using in accordance with the logistical field. Integrated Information Theory (IIT) is one of the most influential theories of consciousness, mainly due to its claim of mathematically formalizing consciousness in a measurable way. However, the theory, as it is formulated, does not account for contextual observations that are crucial for understanding consciousness. Here we put forth three possible difficulties for its current version, which could be interpreted as a trilemma. Either consciousness is contextual or not. If contextual, either IIT needs revisions to its axioms to include contextuality, (...) or it is inconsistent. If consciousness is not contextual, then IIT faces an empirical challenge. Therefore, we argue that IIT in its current version is inadequate. (shrink)

A primeira tese de Sober é que não podemos agir livremente, a não ser que o Argumento da Causalidade ou o Argumento da Inevitabilidade tenham alguma falha. O Argumento da Causalidade é o seguinte: nossos estados mentais causam movimentos corporais; mas nossos estados mentais são causados por fatores do mundo físico. Nossa personalidade pode ser reconduzida à nossa experiência e à nossa genética. E tanto a experiência quanto a genética foram causados por itens do mundo físico. Assim, o meio ambiente (...) e os genes são os causadores de nossas crenças e desejos. E estes, por sua vez, causam o nosso comportamento. Como, em última instância, não escolhemos nem os nossos genes e nem o meio ambiente no qual adquirimos as nossas experiências, também não escolhemos o nosso comportamento: ele é causado por fatores além do nosso controle; isso nos faz não ser livres. E o Argumento da Inevitabilidade é exposto por Sober assim: se uma ação foi praticada livremente, então deve ter sido possível ao agente agir de outra forma. Mas, dado que as causas de nossas ações são as nossas crenças e desejos, não poderíamos ter agido diferentemente de como elas nos determinam a agir. (shrink)

The purposes of this paper are: (1) to present four theories of the nature of natural laws, (2) to show that only one of them is capable of adequately answering to Tooley's Cases, and (3) indicate why these cases are relevant for our ontology. These purposes are important since the concept of "natural law" is used in many (if not all) realms of natural science and in many branches of philosophy; if Tooley's cases are possible, they represent situations that must (...) be adequately described. If there is only one theory that can adequately describe such cases, there are strong reasons to prefer this theory over the other ones. (shrink)
